Maisara Abu Hamdiyeh is the second Palestinian prisoner in as many months to have died in Israeli custody.


Maisara Abu HamdiyehPrisoners in Israel’s Ramon Prison recently rose up in protest for fellow inmate Maisara Abu Hamdiyeh, who died of throat cancer on April 2. Attributing his death to a late diagnosis and improper medical treatment, protesters are also being heard throughout Gaza, Jerusalem, and the West Bank.

Hamdiyeh originally complained of throat pain in August of 2012 and in January was diagnosed with esophageal cancer. It is unclear what sort of medical treatment, if any, he had been receiving up until his death, and reports from each side vary. Palestinians claim medical negligence, while Israelis say that adequate medical treatment was provided.

Following the announcement of Hamdiyeh’s death, prison protests prompted Israeli guards to fire tear gas on inmates in their cells—who were only guilty of “banging on their cell doors and throwing objects around” according to the BBC. This appeared to backfire however, as six guards along with three inmates were sent to the prison clinic after the teargas was used.

In solidarity with prisoners, Palestinian citizens took to the streets in protest. In Hamdiyeh’s hometown of Hebron demonstrators threw rocks at Israeli soldiers, who retaliated by launching tear gas canisters and firing rubber-coated bullets into the crowd.

Israel continues to show blatant disregard in addressing basic needs of Palestinians in the prison system, significantly increasing tensions in this already polarized society.

Who will be the next victim of the Israeli prison system?

Israel seems to have fewer and fewer qualms about being branded apartheid.

Israel’s continued disregard for Palestinians is yet again highlighted in its latest segregation of the region’s bus system—modern day apartheid at its finest. Especially problematic is the fact that the bus system is a public service and under law should employ nondiscriminatory practices. The Palestinian Deputy Labor Minister and the Workers’ Union have denounced the “racist measures.”

The Israeli transportation authorities have said that segregation of the bus lines was put into effect to improve overall service for Palestinians by making the transport more effective. They also claim costs will fall—Palestinians will no longer be required to pay high prices for private, unregulated taxis to bring them to and from checkpoints.

Media reports indicate, however, that Jewish settlers lodged complaints with the government concerning safety on the buses with Palestinians aboard. Settlers also claimed buses were crowded and that high tensions between Palestinians and settlers pose security risks. This reasoning is likely the real reasoning for this troublesome policy.

The plan has drawn the opposition of the Israeli Knesset’s more progressive members. Zahava Gal-On, leader of the leftist Meretz leftist political party, called for the immediate cancellation of the segregated bus lines. “Separate bus lines for Palestinians prove that occupation and democracy cannot coexist,” he said. The Israeli human rights group B’Tselem also condemned the move, calling it “revolting.”

A few citizens took drastic measures to protest the segregation policy by setting aflame two of the buses just one day after its implementation. Discontent amongst Palestinians is apparent—how much further will Israel go to isolate this continually marginalized population?

The monetary savings of having segregated bus lines may be helpful to Palestinians but overall this policy does nothing to improve or even sustain the delicate political balance between these two populations. Israel continues to implement segregationist policies, pushing political boundaries to the breaking point while at the same time having no regard for the resulting repercussions.

Did Arafat Jaradat Die Under Interrogation?

A case of the conflicting autopsies: Palestinian and Israeli.

On Saturday, Palestinian prisoner Arafat Jaradat died from wounds suffered while being held in an Israeli prison. Israeli officials claimed Jaradat died from a heart attack but now say the autopsy evidence is inconclusive. Palestinian officials determined his death was the result of torture.

Arafat JaradatDescribed as being in good health by his family and friends, it seems unlikely that 30-year-old Arafat would succumb to a heart attack. An autopsy revealed a slew of bodily injuries incurred during Jaradat’s five-day incarceration. These include: six broken bones in the neck, spine, arms, and legs, severe bruising on the back and chest, broken ribs, muscular wounds to the shoulder, chest and right hand, and facial bruising with bleeding from the lips and nose. Jaradat’s heart was healthy with no signs of damage.

The UN Security Council and UN Middle East peace envoy, Robert Serry, have called for an “independent and transparent investigation” to establish the cause of death in this case. The inquiry presents a likely catch-22 for these investigating bodies.If the report finds prison authorities complicit in the torture of Jaradat there could be an outbreak of unrest. If authorities are not found responsible Palestinians will likely say the investigation is swayed in Israel’s favor, generating significant outcry.

The back-and-forth only deepens the escalating tensions that have come to a head in past weeks. Thousands of prisoners have been participating in widespread hunger strikes to protest Israel’s administrative detention policy and bring attention to their plight. The death of Arafat Jaradat only swells the anger and outrage felt by Palestinians that could soon boil over.

The upheaval comes as President Obama is set to visit the region in the coming weeks. Israeli Defense Minister, Amos Gilad, is already claiming that Palestinian medical officials are jumping to conclusions to “stir things up” in advance of the president’s visit. But thus far Palestinians have only called for justice and fairness for detained prisoners, to avoid another tragedy like the death of Arafat Jaradat.  

Exactly Why Is President Obama Going to Israel?

Both Israel and the United States seek to quash expectations that the visit will jump-start the Israeli-Palestinian peace process.

While Israeli Prime Minister Benjamin Netanyahu says he and U.S. President Barak Obama have agreed that when the U.S. President visits Israel they would discuss “three main issues ... Iran's attempt to arm itself with nuclear weapons, the unstable situation in Syria ... and the efforts to advance the diplomatic process of peace between the Palestinians and us," that’s not exactly what others are saying in either Washington or Tel Aviv.

As soon was announced that the President would be visiting the Middle East, supporters of the policies of the Netanyahu government went into overdrive in an effort to throw cold water on any idea that the diplomatic mission could achieve any breakthrough in the Israeli-Palestinian “peace process.”

“While the US ambassador to Israel said today that Mr. Obama would visit the country with an ‘urgent’ mission to revive peace negotiations, Israeli diplomats said talks with Benjamin Netanyahu would focus on Iran,” reported the British daily Telegraph. “The peace process may be the subject that is initially emphasized in public but there are other issues on the table that must be addressed before the summer,” one diplomat told the paper, alluding to Israel's spring deadline for Iran to stop enriching uranium. “The deal they will have done may be on the subject of war, not of peace.”

“There are currently bigger and much more urgent issues to address than the Palestinian-Israeli conflict,” one Israeli official told the Telegraph.

To say the U.S. moved quickly to squash any expectation that the President’s visit to the Middle East might move toward resolving the Palestinian-Israeli conflict would be an understatement. At a press briefing February 6, White House Press Secretary Jay Carney said that “this is a trip the President looks forward to making that is timed in part because we have here obviously a second term for the President, a new administration, and a new government in Israel, and that's an opportune time for a visit like this that is not focused on specific Middle East peace process proposals. I'm sure that any time the President and Prime Minister have a discussion, certainly any time the President has a discussion with leaders of the Palestinian Authority, that those issues are raised. But that is not the purpose of this visit.”

Writing in Foreign Policy magazine, national security and foreign policy commentator Josh Rogin quoted former Congressman Robert Wexler, the president of the S. Daniel Abraham Center for Middle East Peace, as saying, "I don't think it would be prudent to raise expectations on the Israeli-Palestinian conflict. The trip is about Israeli security in the face of Iran's nuclear program and in the context of the violence and conflict in Syria. Certainly the Israeli-Palestinian conflict is an important part of that, but I don't think it would be accurate to highlight the Israeli-Palestinian conflict over other aspects of the relationship."

All of this would seem to raise the question: why is he going?

In response to the demands of the Republicans and rightwing supporters of the Netanyahu government that he make such a pilgrimage? Not likely.

To bolster the standing of Netanyahu following the shellacking he and his Likud party suffered in the recent Israeli parliamentary elections? That has been suggested by Israeli critics of government policy.

To engage the embattled regime of Jordan’s King Abdullah II, with whom Obama will also meet after the visit to Israel, as some have suggested? That last suggestion is not farfetched. One element largely overlooked so far in the discussion about Obama’s visit next month is that he will also visit Amman.

“With the region already in flames – Egypt no longer a reliable US partner, and Syria in utter chaos – stability in the Hashemite Kingdom and the survivability of King Abdullah II is a crucial interest not only to Israel, but to the US,” wrote Keinon in the Jerusalem Post,” adding that Obama’s visit to Amman “and the signal that sends of US support for Abdullah – is not insignificant.” Evidence that Washington is concerned about the stability of the Jordanian regime has been around for some time.

Last October, the U.S. rushed troops to the Jordan-Syria border to bolster that country's military capabilities. One hundred military planners and others are already on the scene, operating from a joint U.S.-Jordanian military center, and the U.S. forces are said to be building another base for themselves. U.S. Secretary of Defense Leon Panetta said the move was prompted by developments in adjacent Syria. 

On January 28, Abdullah II met with Khaled Mashaal, leader of the Palestinian political movement Hamas for the third time in one year. Abdullah is said to have told Mashaal that direct negotiations with Israel and the creation of a timetable for the two-state solution are “the only way to achieve security and stability in the Middle East.” Mashaal was reported to have said later that he and the king had discussed the inner-Palestinian reconciliation and examined the Palestinian issue and its future in light of the then upcoming U.S. and Israeli elections.

Mashaal, a Jordanian citizen, was exiled from the country in 1999, accused of being a risk to Jordan’s security.

During the meeting the king expressed his support of the inter-Palestinian reconciliation attempt, saying it forms the basis to bolster the Palestinian people's unity and that only through unity could they achieve their legitimate rights, including a Palestinian state's establishment.

Last year, Abdullah II met twice with Palestinian Authority President Mahmoud Abbas in Ramallah.

On the other hand, there has been some speculation that there is, indeed, agreement between Washington and Tel Aviv on an approach to the Palestinian question. It’s called “get Israel and the Palestinians back to the negotiating table.” That’s the way U.S. Ambassador to Israel Daniel Shapiro put it last week.

Herb Keinon, diplomatic correspondent for the Jerusalem Post, wrote February 8 that the U.S. “is looking for something from Jerusalem to dangle in front of the Palestinians and thereby bring the Palestinian Authority back to the negotiating table.”

It didn’t dangle long.

A headline two days later said it all: “Israel approves new settler homes ahead of Obama visit.”

It’s hard to get more provocative than that.

In defiance of international law that bars an occupying power transferring citizens from its own territory to occupied territory – and overwhelming world public opinion  – the Netanyahu regime has decided to build additional 90 units – the first of a planned 300 unites – in the Bet El illegal settlement, just east of the central West Bank city of Ramallah, the majority Christian capital of the Palestinian Authority.

“The advancement of this program could overshadow Obama’s visit,” said Yariv Oppenheimer, a spokesman for Peace Now, an Israeli group that opposes settlement construction to the media. “This is a misguided and ill-timed decision.”

Misguided it was but there is little reason to think the timing was unintentional.

One idea being floated in the Israeli media (but so far disavowed by the government) is that Netanyahu has offered to suspend settlement activity in the West Bank, except in Jerusalem and around existing colonial blocks.

“While there are no guarantees, it is hard to believe that if Netanyahu made such an offer, and Obama and his new Secretary of State John Kerry pushed hard on Ramallah, PA President Mahmoud Abbas would reject it,” Keinon wrote February 8. “And one of the arguments likely to be used in prodding the Palestinians is that a failure to accept the offer, a continued refusal to reenter talks, could have negative repercussions on an already precarious Jordan.”

“The Palestinian position is clear,” Nabil Abu Rdainah, a spokesman for Palestinian President Mahmoud Abbas, said in response to the new Beit El construction. “There can be no negotiation while settlement continues."

The Secretary-General of Palestinian People's Party Bassam al-Salhi told the news agency Ma'an that Obama’s visit may create the "illusion" of returning to negotiations, but would have no impact on the peace process. Jamal Muhaisen, a member of the Central Committee of the Palestinian political party Fatah, said negotiations can resume only when Israel fulfills its previous commitments under international law and stops settlement construction on occupied land.

Hanan Ashrawi, a senior official with the Palestine Liberation Organization and member of the Palestinian National Council, said she and other Palestinians would welcome Obama’s visit “if it signals an American promise to become an honest and impartial peace broker…which requires decisive curbs on Israeli violations and unilateral measures, particularly settlement activity and the annexation of Jerusalem, as well as its siege and fragmentation policies.”

“Negotiating in good faith means you don’t place preconditions,” Netanyahu recently told a group of settlers. “In the last four years, the Palestinians have regrettably placed preconditions time after time, precondition after precondition. My hope is that they leave these preconditions aside and get to the negotiating table so we don’t waste another four years.” Well, not exactly. The chief impediment to achieving a solution to the conflict has been and remains the Israeli governments continued colonial expansion. While Netanyahu’s rightwing Likud party didn’t do as well as it had expected to in the last election, gains were made by coalition partners even further to the right who oppose a Palestinian state and advocate outright annexation of major parts of the West Bank.

“Should we be happy or not?” Israeli writer Uri Avnery asked last week, concerning the upcoming visit of the U.S President. Writing from Tel Aviv in Counterpunch, he answered: “Depends. If it is a consolation prize for Netanyahu after his election setback, it is a bad sign. The first visit of a US President since George Bush Jr. is bound to strengthen Netanyahu and reinforce his image as the only Israeli leader with international stature.

But if Obama is coming with the intention of exerting serious pressure on Netanyahu to start a meaningful peace initiative, welcome.

Netanyahu will try to satisfy Obama with "opening peace talks." Which means nothing plus nothing.

Yes. Let’s talk. "Without preconditions." Which means: without stopping settlement expansion. Talk and go on talking, until everyone is blue in the face and both Obama’s and Netanyahu’s terms are over.

“But if Obama is serious this time, it could be different,” wrote Avnery, a founder of the Gush Shalom peace movement, who has been advocating a two-state solution for decades. “An American or international blueprint for the realization of the two-state solution, with a strict timetable. Perhaps an international conference, for starters. A UN resolution without an American veto.”

Soon after the 2006 war with Lebanon, it became clear that Israel's Achilles heel was the fear that demoralized its population.

On Wednesday November 21, under an Egypt-brokered deal, Palestinians and Israelis agreed to end all hostilities against each other after eight days of relentless Israeli attacks on the coastal enclave. Israel also agreed to open all crossings and facilitate the movement of people and goods in and out of the Gaza Strip. But it did not accept a proposal to lift the blockade of the Gaza Strip. Over 160 Palestinians, mostly women and children, were killed and about 1,200 others were injured in over 1,500 Israeli attacks on Gaza that were carried out during the eight-day period of November 14-21. It is too early to tell whether the ceasefire will hold for very long, and if it does, whether its central provisions will be implemented. 

For those who still remember the Israeli attack on Gaza four years ago and the slaughter of Palestinian civilians and the repeated violation of ceasefire agreement by the Israelis, the current ceasefire should hold no hope, especially as we have begun to notice similar patterns of violations taking place again. Looking back  four years, to the end of ‘Cast Lead’ and since then and up to the beginning of last Israeli attack, 271 Palestinians, according to the Israeli human rights organization B’tselem, have been assassinated by Israeli air strikes, by drones, by planes, by helicopters and ZERO Israelis killed by Palestinian rockets.

Israel has already used excessive violence to disperse Palestinian civilians who gathered on the Gaza side of the border, with a few straying across into Israel, to celebrate what they thought was their new freedom now to venture close to the border. This so-called ‘no-go-area’ was decreed by Israel after its 2005 ‘disengagement’ had been a killing field where 213, including 17 children and 154 uninvolved, had lost their lives. Only in the last few days, Israeli security forces, after firing warning shots, killed one Palestinian civilian and wounded another 20 others with live ammunition. Despite this note of pessimism there are a number of fundamental differences between the situation in Gaza and Hamas fighters in Gaza in 2012 compared to 2008.

First, the change of dynamics resulting from the Arab Spring and change in Egypt. The two regional countries that the U.S. needs badly to act as interlocutors, and isolate Hamas — Turkey and Egypt — are arguably right now the closest and most important allies of Hamas. Israel is more isolated than Hamas and has fewer friends. Even the British Foreign secretary, who under normal circumstances is only good for rubber stamping whatever Israelis does, this time took a cautionary approach and did not offer any support for a ground invasion.

The fact that Israel cannot count on diplomatic support from U.S.-oriented regimes such as Mubarak of Egypt creates a new dynamic in the Middle East and puts far greater pressure on Israeli leaders to be more realistic in their approach to the peace process. This generates a better environment for a more realistic and pragmatic approach to finding a longer lasting, and more permanent peace in the Middle East.

The second difference in my assessment is Hamas’ acquisition of more sophisticated weapons dealt a serious blow to Israeli morale. These long-range missiles allowed Hezbollah in Lebanon during the 2006 Israeli war not only to secure itself against Israeli aggression, most importantly: it created a more symmetrical confrontation by taking the war into cities in the occupied territories that had been immune from any attack for a long time.

The attack on Tel Aviv soon after the first Israeli attack on Gaza in the latest war, not only was a shock to the political leadership in the Israeli government, it heralded a new chapter in the relation between the freedom fighters in Gaza and the Israeli occupying forces. These weapons turned the table of confrontation with Israel in favor of Gaza and made another Israeli victim feel bold enough, if not fully secure, to confront it with a real sting.

One does not need a complicated analysis to conclude that if the fighters in Gaza have gained access to missiles that can reach Tel Aviv and Jerusalem, then they must have acquired anti-tank weapons similar to those that were used by Hezbollah in 2006 with devastating consequences for the Israeli tank divisions and especially for Markova 4 tanks that the Israelis had invested so much in constructing an image of invincibility around it globally.

It became clear soon after the 2006 war with Lebanon that the Achilles heel of the Israelis was the fear factor that demoralized its population. The fact that, in 2012 as in 2006, it was Israel who proposed the truce, clearly indicate that for the military leaders in Israel, a scared population is not the same as the dead Gazans are for Hamas – scared populations would sap the shaky morale in Israel even further, while for the freedom fighters in Gaza, innocent civilian casualties energize them to go an extra-mile to avenge.

Like the 2006 war, the underdog, Hamas, comes out of this confrontation in much more favorable status than the Zionist regime in Tel Aviv. Despite all the military shields, Hamas was able, even in the last hours of the conflict, to attack Israel. This has certainly enhanced Hamas’s prestige among Palestinians and in the Arab world, and, in a ‘zero sum gain’ relationship, any gain of prestige by Hamas by necessity implies a loss for the Palestinian Authority under Mahmoud Abbas. It will be more difficult than ever to bolster the Fatah leadership on the West Bank as Hamas grows in stature.

The third outcome of this war is political recognition given to Hamas leadership by a number of Arab leaders. During the attacks several leading foreign ministers from the region visited Gaza and were received by the Hamas governing authorities, thus undermining the Israeli policy of isolating Hamas and excluding it from participation in diplomacy affecting the Palestinian people. As Richard Falk has stated:

. . . throughout this just concluded feverish effort to establish a ceasefire, Hamas was treated as if ‘a political actor’ with sovereign authority to speak on behalf of the people living in Gaza. Such a move represents a potential sea change, depending on whether there is an effort to build on the momentum achieved or a return to the futile and embittering Israeli/U.S. policy of excluding Hamas from diplomatic channels by insisting that no contact with a terrorist organization is permissible or politically acceptable.

The most important outcome of the latest attack has been the strengthening of the argument that the existence of more parity in the region would undermine the hawkish and belligerent Israeli position that so far, with the overt and covert support of the US, has not agreed to implement any treaties agreed upon in the previous negotiations and by implication would lead to a softening of such a position making a long term resolution of this conflict more likely. I hope this realization would lead to less saber rattling about attacking Iran.

Like Hezbollah in 2006, Hamas has punched a big hole in Israel’s overinflated air ego balloon sending the military leaders to the drawing board. This may be an opportune moment for the peace lovers in the region to become more active. They may be able to prevent this carnage from being repeated again.
